Please read the amendment article of Jan 2018. First SC declered that 377 is unconstitutional.. afterward they amend the law completely ... Please check once...

sorry Sir, i checked again, law has not been amended. However, the import of whatever you say is correct. Let us share what supreme court said,

On 6 September 2018, the Supreme Court of India ruled that the application of Section 377 to consensual homosexual sex between adults was unconstitutional, "irrational, indefensible and manifestly arbitrary",

Portions of the section were first struck down as unconstitutional with respect to gay sex by the Delhi High Court in July 2009.hat judgement was overturned by the Supreme Court of India (SC) on 11 December 2013 in Suresh Kumar Koushal vs. Naz Foundation. The Court held that amending or repealing section 377 should be a matter left to Parliament, not the judiciary.In January 2018, the Supreme Court agreed to hear a petition to revisit the 2013 Naz Foundation judgment. On 6 September 2018, the Court ruled unanimously in Navtej Singh Johar v. Union of India that Section 377 was unconstitutional "in so far as it criminalises consensual sexual conduct between adults of the same sex".
However, no amendment was made nor needed.

Secondly it is section not article. Article is used only for the constitution.

Thirdly, there are many such ' laws' pronounced by the supreme court which no body can find in statue books and the most famous being ' basic features doctrine' which fetters Parliament to make a law which goes against the basic feature of the constitution. But in the entire constitution there is no word like ' basic feature.

I was trying to bring to attention the funny part of 377. If two ladies indulge ( even before SC judgment ) in cunniliguous, it would not have attracted 377 as no penetration was involved but if they use their fingers , it will be attracted as penetration is the basic part of 377. Similarly ' hand job ' does not involve penetration but is ' unnatural'.

Talking about 'words' i wonder for women -women relation there are soft beautiful words like ' Sapphic' ( Sapho -Poetess 630-570 BCE0 ) and island of lesbos where Sapho lived gave a very popular word, we all know. But what was the word for man-man as it was not uncommon in the ancient rome or greece. is there any reference in Indian Literature. At least there is a word for oral sex in Kamsutra.

Topic was triggered by some discussion on a story thread, but here i am using " Gay' in different perspective.

The word gay arrived in English during the 12th century from Old French gai, most likely deriving ultimately from a Germanic source.

In English, the word's primary meaning was "joyful", "carefree", "bright and showy", and the word was very commonly used with this meaning in speech and literature. For example, the optimistic 1890s are still often referred to as the Gay Nineties. The title of the 1938 French ballet Gaîté Parisienne ("Parisian Gaiety"), which became the 1941 Warner Brothers movie, The Gay Parisian,[10] also illustrates this connotation..

By the late 17th century, it had acquired the specific meaning of "addicted to pleasures and dissipations", an extension of its primary meaning of "carefree" implying "uninhibited by moral constraints". A gay woman was a prostitute, a gay man a womanizer, and a gay house a brothel.


An example is a letter read to a London court in 1885 during the prosecution of brothel madam and procuress Mary Jeffries that had been written by a girl while slaved to a French brothel:



Now let's look at the law, section 377 which has now been partly decriminalized, stands like this,

Unnatural offences.—Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with 1[imprisonment for life], or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine. Explanation.—Penetration is sufficient to constitute the carnal intercourse necessary to the offence described in this section.

It uses two words, one against the order of nature and second derived from there Unnatural offences, ..., what is order of nature - coitus for procreation.

so masturbation, lesbian sex and anal sex with a female is also 'unnatural.'

There is another issue, Gay and Bi- a person who indulges with sex of both sex is called Bi- and not gay or lesbo. Is Gay a social, psychological behavior or only a sexual proclivity?
